Terms of Use

Effective .

1. This agreement

These Terms of Use are a binding contract between you and Carson Martin, a sole proprietor in the United States trading as Verdikt AI (“we”, “us”). They govern your use of https://verdiktai.com and everything on it.

By creating an account, subscribing, or using the site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Who may use the service

You may use Verdikt AI only if all of the following are true:

  • you are at least 18 years old and able to form a binding contract;
  • you are not barred from receiving this kind of content under the laws that apply where you are;
  • your account has never previously been terminated by us for breach of these Terms;
  • you are acting for yourself, not on behalf of an undisclosed business.

Laws about sports-wagering content differ enormously by country, state and province, and some set a minimum age of 21 or prohibit the content entirely. Working out what applies where you are is your responsibility, not ours. If access is unlawful where you are, you must not use the service.

3. What the service is, and what it is not

Verdikt AI publishes statistics about professional mixed martial arts athletes, historical and current betting market odds compiled from public sources, and predictions generated by statistical models.

Nothing on this site is betting advice, investment advice, financial advice, tax advice or professional advice of any kind, and no content should be treated as a recommendation to place any wager. We are not your fiduciary, adviser or agent. No relationship of trust or reliance arises between us.

Odds shown are compiled from third-party sources for information. They are not offers, they are not guaranteed to be current or accurate, and they may differ from what any sportsbook will actually give you. We have no control over any sportsbook’s prices, availability, limits or conduct.

4. Predictions, accuracy and past performance

Combat sports are high-variance. A fight can turn on a single exchange, a late replacement, a weight miss, an injury, a judging decision or a result later overturned by a commission. No model can account for these, and ours does not try to.

Where we publish historical performance — hit rates, returns, or comparisons against market prices — those figures describe past results over a stated sample and period, calculated from our published archive. Past performance does not predict future results. A positive historical return is not a forecast, and results over any sample this size are consistent with a wide range of true performance, including worse than the figures shown. Nobody should treat those numbers as an expected return.

Statistics, records and fight histories are compiled from public sources that themselves contain errors and are sometimes revised. We correct what we find and publish a corrections route, but we do not warrant that any figure is accurate, complete or current.

Every decision you make using this service is yours alone, and you bear all of its consequences.

5. Responsible gambling

If you choose to gamble, treat it as entertainment you can afford to lose, never as income and never as a way to recover losses. Do not gamble with borrowed money.

Free, confidential help is available:

If gambling has stopped being fun for you, please close your account and email us at verdiktlabs@gmail.com; we will remove you from all marketing and will not attempt to win you back.

6. Your account

Accounts are personal and individual. Keep your password confidential, and tell us immediately if you think someone else has access. You are responsible for everything done through your account, except activity arising from our own failure to secure the service.

You may not share, sell, rent, lend or transfer your account or your access credentials. One person, one account.

Give us accurate information when you register and keep it current. We may suspend an account registered with information we reasonably believe to be false.

7. Subscriptions, renewal and cancellation

What you are agreeing to pay

Paid plans are sold as recurring subscriptions. Before you are charged, the checkout page shows the plan, the price, the billing interval and the date of your first charge. By subscribing you authorise us and our payment processor, Stripe, to charge your chosen payment method on that schedule.

How to cancel

You can cancel at any time from your account settings, in the same number of steps it took to subscribe, without talking to anyone. Cancellation stops the next renewal. You keep access for the rest of the period you have already paid for.

If you cannot reach the cancellation control for any reason, email verdiktlabs@gmail.com from your account address and we will cancel it for you. A cancellation request sent by email takes effect on the day we receive it.

Refunds

Except where the law says otherwise, payments are non-refundable and we do not give credits for partial periods or unused access. This does not affect your statutory rights. In particular, consumers in the United Kingdom and European Union have a 14-day right to cancel a distance contract; where you ask us to begin providing the service immediately within that period, you may be charged for what you have used before cancelling.

If we charge you in error, tell us and we will refund it. We would rather refund a disputed charge than argue about it, so contact us before raising a chargeback.

Price changes

We may change subscription prices. We will give you at least 30 days’ notice by email before a new price applies to your renewal, and the notice will tell you how to cancel. Continuing past the renewal date means you accept the new price.

Failed payments and taxes

If a payment fails we may retry it and may suspend paid access until it succeeds. Prices exclude taxes unless stated; you are responsible for any tax due on your purchase other than tax on our income.

8. Acceptable use

You agree not to:

  • scrape, crawl, harvest or bulk-download content, or use any automated system to access the service, except a search engine obeying our robots.txt;
  • copy, redistribute, resell, sublicense or publish our data, predictions or odds, whether free or for a fee, or use them to build a competing product or model;
  • share paid content with people who have not paid for it, including by posting picks publicly;
  • circumvent, disable or probe any access control, paywall, rate limit or security measure, or access data your plan does not include;
  • reverse engineer, decompile or attempt to derive our models, source code or training data;
  • interfere with the service’s operation, including by overloading it, or upload anything malicious;
  • use the service to break any law, to launder money, or to facilitate gambling that is illegal where it takes place;
  • misrepresent your identity, impersonate anyone, or claim affiliation or endorsement you do not have;
  • use the service in a way that suggests we endorse a wager, a sportsbook, or any outcome.

We may investigate suspected breaches and take any step we consider appropriate, including suspension, termination, and reporting to law enforcement.

9. Our content and your licence to use it

The service, and everything in it other than your own content and third-party material — including our software, models, model outputs, compiled datasets, derived metrics, text, design, and the Verdikt AI name and logo — belongs to us or our licensors and is protected by intellectual property law.

While your account is in good standing we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the service for your own personal, non-commercial purposes. That licence is all you get; every other right is reserved. It ends when your access ends.

You may quote small extracts for commentary, news reporting or criticism if you credit Verdikt AI and link to the page you took them from. Systematic extraction is not fair use and is not permitted.

Underlying facts — who fought whom, and who won — are not owned by anyone. Our compilation, presentation, derived statistics and model outputs are.

Fighter names, promotion names and sportsbook names are the trademarks of their owners and are used descriptively. We are not affiliated with, endorsed by, or sponsored by the Ultimate Fighting Championship, any promotion, any athlete, or any sportsbook.

10. Content you create

Notes and other material you save remain yours. You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce and display that content solely to operate the service for you. We do not publish it, sell it, or use it to train models.

You are responsible for what you save, and you confirm you have the right to save it. Do not store anything unlawful, infringing, or belonging to someone else.

If you send us feedback or suggestions, we may use them without restriction or obligation to you. Please do not send us confidential information.

12. Third-party services and links

The service depends on third parties, including Google Firebase for accounts and storage, Stripe for payments, and external providers for odds and athlete data. Their terms apply to their parts, and interruptions or errors originating with them are outside our control.

Links to other sites are provided for convenience. We do not control them, do not endorse them, and are not responsible for their content, products, practices, or for any loss arising from your dealings with them. That includes any sportsbook.

13. Disclaimer of warranties

We do not warrant that the service will be uninterrupted, timely, secure or error-free, that defects will be corrected, that any content, statistic, odd or prediction is accurate, complete or current, or that the service will produce any particular result.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

14. Limitation of liability

We are specifically not liable for money you lose betting, whether or not the bet followed a prediction, statistic or odd published here.

Our total aggregate liability for all claims relating to the service is limited to the greater of the amount you actually paid us in the twelve months before the event giving rise to the claim, or fifty United States dollars.

These limits apply to every theory of liability — contract, tort, negligence, strict liability, statute or otherwise — and survive any failure of an essential remedy. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you, and nothing here limits liability that cannot lawfully be limited.

15. Indemnification

You will indemnify and hold harmless Verdikt AI and its operator, and their agents and contractors, from any claim, loss, liability, cost or expense, including reasonable legal fees, arising from your use of the service, your breach of these Terms or of any law, your infringement of anyone’s rights, or any bet you place. We will tell you promptly about any claim, and you may not settle it in a way that imposes any obligation or admission on us without our written consent.

16. Dispute resolution, arbitration and class waiver

Talk to us first

Before starting anything formal, email verdiktlabs@gmail.com describing the problem and what you want. Most things are fixable this way. Give us 30 days to resolve it.

Agreement to arbitrate

If we cannot resolve it, you and we agree that any dispute arising out of or relating to these Terms or the service will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.

Arbitration will be seated in Missoula County, Montana, or conducted by telephone, video or on documents alone at your election. If the value of your claim allows it to be heard remotely, you will never have to travel.

Exceptions

Either of us may bring an individual claim in small-claims court instead, and either of us may seek an injunction in court to stop infringement or misuse of intellectual property.

Class action waiver

Your right to opt out

You may reject this arbitration agreement within 30 days of first accepting these Terms. Email verdiktlabs@gmail.com with the subject line “Arbitration Opt-Out”, stating your name and the email on your account. Opting out costs you nothing, changes nothing else about your account, and we will not treat you differently for it. If you opt out, disputes go to the courts identified below.

If we change this section, the change does not apply to a dispute we already knew about, and you get a fresh 30-day opt-out window.

17. Governing law and venue

These Terms are governed by the laws of the State of Montana, and the federal laws of the United States that apply, without regard to conflict-of-laws rules. Where arbitration does not apply, you and we submit to the exclusive jurisdiction of the state and federal courts located in Montana. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory rules of your own country’s law, or of the right to bring proceedings in your local courts where that right cannot be excluded.

18. Suspension and termination

You may stop using the service and close your account at any time.

We may suspend or terminate your access if you breach these Terms, if we reasonably suspect fraud, abuse, scraping or credential sharing, if we are required to by law, or if we discontinue the service. Where the reason is not urgent or unlawful conduct, we will give reasonable notice and refund the unused portion of any prepaid period.

Sections that by their nature should survive — intellectual property, disclaimers, liability, indemnity, dispute resolution and governing law — survive termination.

19. Changes to these Terms

We may update these Terms. For material changes we will give at least 30 days’ notice by email to account holders or by prominent notice on the site, and the effective date at the top will change. Continuing to use the service after the new date means you accept the revised Terms; if you do not, cancel before that date and we will refund the unused portion of any prepaid period. Changes never apply retroactively to a dispute that has already arisen.

20. General

Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the service and replace anything said before.

Severability. If any provision is held unenforceable, it is modified to the minimum extent needed to make it enforceable, or severed, and the rest continues in force.

No waiver. If we do not enforce something immediately, we have not given up the right to enforce it later.

Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition or sale of the business.

Force majeure. Neither of us is liable for failure to perform caused by events beyond reasonable control, including outages at our providers.

No third-party beneficiaries. These Terms create rights only between you and us.

Notices. We will contact you at the email on your account; you should contact us at verdiktlabs@gmail.com and, for formal notices, at Missoula, Montana, United States.
